Finding A True Solution To Spam

On July 1st, the CRTC officially implemented its new anti-spam legislation for Canada. We have had a number of clients, colleagues and friends ask us about how this new law will actually prevent them from continually receiving spam from unsolicited businesses. The truth is that the new legislation is making it so that there are more defined rules set in place for business owners looking to grow their brands through email marketing. But it doesn’t guarantee a stop to spam.

In fact, just a few days after the new legislation took effect, CBC News reported that the CRTC received over 1,000 complaints about receiving spam. On their website, they go on to explain exactly how the new law is supposed to work: “The federal legislation requires that businesses get written or oral consent before they send emails or other digital messages to consumers. Companies must also clearly identify themselves in each message and allow consumers to unsubscribe from digital mailings.”

It doesn’t sound like too hard a policy to follow, right? But how can the CRTC guarantee that their new rules are followed? It will simply take some time, we suppose. However, from experience, we know that when companies decide to spam, they simply spam. Even before the CRTC’s new policy became law, it was only right that company owners secured permission to send emails and offered ways for recipients to opt out of emailing lists.

So what really happens if a company commits an infraction against this legislation? According to CBC News, “businesses that violate the law could face financial penalties of up to $10 million per violation, while individuals could be fined up to $1 million per infraction.” Again, only time will tell if anyone will actually be hit with these lofty penalties. It makes one wonder if spam can ever truly be stopped.
